Participation Agreement, Risk Acknowledgement & Disclaimer
Please read this document carefully before registering. By checking the agreement box on the registration form, you confirm that you have read, understood, and accepted these terms.
1. Voluntary participation
I understand that my participation in Sailing into Presence, including sailing, swimming, snorkeling, going ashore, entering and leaving the vessel, shared living aboard, and any other activities during the journey, is voluntary.
2. Inherent risks
I understand that sailing and travel at sea involve inherent and sometimes unpredictable risks. These may include, among other things, changing weather and sea conditions, waves, slips and falls, seasickness, injury, collision, equipment failure, swimming and water-related risks, transport risks, delays, and limited or delayed access to medical assistance.
I accept that not every risk can be anticipated or eliminated.
3. Personal responsibility and instructions
I agree to take reasonable responsibility for my own safety and conduct, to disclose information that may materially affect my safe participation, and to follow reasonable safety instructions given by the skipper, vessel operator, marina personnel, or other responsible persons. The skipper may change the route, itinerary, anchorage, timing, or activities when reasonably necessary for safety, weather, operational, or maritime reasons.
4. Insurance is the participant's responsibility
Personal insurance is not provided by Dor, Naja, or CONNECT. I am responsible for obtaining insurance appropriate to my circumstances and the activities I choose to undertake, including, where appropriate, travel insurance, medical insurance, accident coverage, sailing/water-activity coverage, emergency evacuation or repatriation coverage, and coverage for cancellation, personal belongings, or other losses.
I am responsible for checking that any insurance I purchase actually covers sailing and the activities in which I intend to participate.
5. Health and ability to participate
I am responsible for deciding whether I am physically and practically able to participate in the journey and its activities. I agree to communicate relevant allergies, dietary needs, mobility limitations, medication needs, or other information that is reasonably necessary for safe participation. I remain responsible for my own medication and personal medical needs.
6. Assumption of risk
To the fullest extent permitted by applicable law, I knowingly accept the ordinary and inherent risks associated with the voyage and the activities I voluntarily choose to undertake.
7. Release and limitation of responsibility
To the fullest extent permitted by applicable law, I agree not to hold Dor, Naja, CONNECT, or their team members personally responsible for injury, illness, loss, damage, delay, expense, or other consequences arising from the ordinary and inherent risks of the voyage, my own actions or omissions, the actions of other participants, weather or sea conditions, or events reasonably outside their control.
Nothing in this agreement excludes or limits liability where such exclusion or limitation is prohibited by applicable law. This agreement is not intended to waive rights that cannot legally be waived, including liability that applicable law does not permit a party to exclude.
8. Personal belongings
I remain responsible for my passport, travel documents, money, electronics, luggage, and other personal belongings. Dor, Naja, and CONNECT are not responsible for ordinary loss, theft, or damage to personal belongings except where responsibility cannot legally be excluded.
9. Itinerary and changes
I understand that sailing itineraries depend on weather, sea conditions, marina availability, vessel condition, instructions of the skipper, and other circumstances. Destinations, activities, and schedules shown on the website are therefore plans rather than guarantees and may be changed when reasonably necessary.
10. Conduct aboard
I agree to behave respectfully toward the crew, other participants, the vessel, local communities, and the environment. I understand that conduct that seriously threatens safety or the wellbeing of the group may result in restrictions on participation or, where reasonably necessary, removal from the voyage.
11. Emergency decisions
If an urgent situation arises, I authorize reasonable emergency action to protect health and safety, including contacting emergency services or arranging medical assistance when appropriate. Any personal medical, evacuation, transport, or related costs remain my responsibility to the extent permitted by law and may be claimed through my own insurance.
12. Agreement
By checking the required box in the registration form and submitting my registration, I confirm that I have had the opportunity to read this agreement, ask questions before joining, and make my own decision to participate. I understand the nature of the journey and voluntarily accept these terms.
